- Booking Notice: All bookings must be confirmed by email. Upon confirmation, this contract and terms of agreement must be read and confirmed back via email.

💵 DEPOSIT & PAYMENT POLICY (STRICTLY ENFORCED)
- Deposit Fee: As part of our company policy, we collect a $50 non-refundable deposit fee via Zelle or Venmo ONLY to hold the specific date and time for your party. This deposit must be received along with a signed copy of this agreement to guarantee services.
- • Payment Verification: Screenshots, receipts, emails, text messages, or other proof of payment provided by the client do not constitute payment. A deposit is considered received only when the payment is visible and verified directly in our Zelle or Venmo account. We do not confirm or guarantee a booking based solely on a screenshot or notification provided by the client.
- • Payment Security: We do not accept overpayments or arrangements in which a client asks us to forward, refund, transfer, or send money to another person or third party. We will only use our designated payment methods. We will not follow instructions from a client or third party to call an unfamiliar phone number, click an unexpected payment link, or send money in order to receive or verify a payment.
- • Unverified Payments: If the deposit cannot be independently verified in our account, the booking remains unconfirmed until the deposit is successfully received and verified. The client should not consider the date and time reserved until confirmation has been provided by us.
- Remaining Balance: On the date and time of the event, the remaining balance is due IN CASH ONLYprior to the entertainer’s start time.
🚫 Absolutely NO Zelle, Venmo, or personal checks will be accepted on the day of the event. ONLY CASH PAYMENT IS ACCEPTED FOR THE REMAINING BALANCE. The entertainer needs to leave right after the party; digital apps can take up to 24 hours to clear, and this cash-only policy eliminates any post-party payment delays or conflicts.
⚠️ No Exceptions Policy: Out of respect for our performers’ schedules and to avoid past payment issues, the entertainer will not begin face painting, balloon twisting, or any activities until the cash balance is settled. If payment is not provided upon arrival, the performance will be canceled, and the deposit will be forfeited.
📅 CANCELLATION & WEATHER POLICY
- Cancellations: The $50 deposit fee will be refunded only if the event is canceled at least 14 days priorto the event date. Any cancellation within 14 days of the event will result in the loss of the $50 deposit.
- Rain or Shine: Bookings are not subject to weather. The client agrees to provide an area with protection from extreme temperatures, sun, rain, snow, and excessive wind. Client is responsible for providing an alternate indoor location in the event of inclement weather.
- Day-of Weather Conditions: The client agrees to pay the full contracted amount once the painter has arrived at the location, even if it is raining. Cancellation on the day of the event due to weather results in the loss of the $50 deposit. However, you may reschedule another event within 30 days of the original event date with no additional deposit fee, subject to availability.
👶 ADULT SUPERVISION & BALOON SAFETY
- Our services are not to be treated as child care or babysitting. Responsible adults must be present at all times. Children’s behavior and safety are entirely the client’s and/or parents’ responsibility.
- Choking Hazard Warning: Balloons and balloon pieces pose a serious risk of suffocation and choking, especially for those ages 3 and under. Adult supervision is required, and we do not recommend giving balloons to anyone ages 3 and under. By signing this agreement, you accept any and all risks associated with the safety of those attending your event.
🎨 HEALTH, LIABILITY, & ARTWORK LIMITATIONS
- Health & Safety: For sanitary reasons, artists will not paint anyone who is or appears to be sick, or is suffering from cold sores, conjunctivitis, ringworm, sunburn, eczema, infectious skin conditions, or open wounds. For safety reasons, artists will not paint children under 2 years old or anyone who is unwilling. These determinations are made strictly at the artist’s discretion.
Allergy Notice: While we use ONLY FDA-approved cosmetic grade face painting supplies, the artist is not liable for allergic reactions. People with skin allergies or sensitive skin should not participate or should request a patch test at the start of the party. Darker face paints may linger and must be removed with mild soap, water, and a washcloth.
Property Damage: Artists use reasonable care but are not responsible for damage to clothing or property. The client agrees to pay for any accidents or injuries caused by pets or guests, as well as any damage to the artist’s equipment or supplies caused by pets, lawn sprinklers, or guests.
Limitations on Artwork: If in public, the artist will not paint on any part of the body that is not legal to expose, or any area they do not feel comfortable painting. Artists will not paint any design or wording that is obscene, offensive, violent, or defies good taste.
🛑 EXTREME ADVERSE WORKING CONDITIONS
- The artist has the right to cease painting and leave without refunding any monies if there are extreme adverse working conditions and the client fails to remedy the situation after it has been brought to their attention. Adverse conditions include, but are not limited to: destructive, violent, or extremely inappropriate behavior of a child, parent, pet, or adult; illegal activities; or otherwise dangerous conditions.
🪑 WORKING SPACE & PARKING REQUIREMENTS
- Working Space: Please provide at least 4 feet of adequate space for the performance during balloon twisting or other activities.
- Work Station Setup: When the artist does face painting, she/he may need to borrow a table and 2 chairs. If you cannot provide a table and chairs, please text 408-483-1061 ahead of time to arrange the workstation setup with the artist.
- Parking Stall: Please reserve one parking stall for the entertainers to park at the event venue. Clients are responsible for any parking fees incurred due to the location of the event.

By replying to our booking email with confirmation, or by signing below, the client agrees that they have read, understood, and accepted all terms, conditions, and payment structures listed above.
